Randomized controlled trials test new drugs using various debiasing devices to prevent participants from manipulating the trials. But participants often dislike controls, arguing that they impose a paternalist constraint on their legitimate preferences. The 21st Century Cures Act, passed by US Congress in 2016, encourages the Food and Drug Administration to use alternative testing methods, incorporating participants’ preferences, for regulatory purposes. We discuss, from a historical perspective, the trade-off between trial impartiality and participants’ freedom. We argue that the only way (...) out is considering which methods improve upon the performance of conventional trials in keeping dangerous or inefficacious compounds out of pharmaceutical markets. The debate about the meaning of color terms in the philosophy of language has been dominated by two main issues. Firstly, there is the discussion about the context-dependency of color terms, specifically, quantity, the degree to which the object is of the color, and one of the dimensions of color quality, hue. Secondly, there is the question of how indexical contextualism can account for these elements of context-dependence. The aim of this chapter is twofold. First, to examine brightness, one of (...) the dimensions of color quality that has been neglected in the literature. For this purpose, we will examine how the equivalent of “white” in Arabic and Spanish interacts with brightness modifiers. The analysis will allow us to distinguish three different usage patterns, light source, light reflection, and contrast between white and black, pointing to three new ways of contextual incompleteness of color terms. Second, to assess indexical theories of color terms considering these new empirical findings. We will argue that the results of our study offer support for indexical contextualist theories by distinguishing new dimensions of contextual incompleteness of color terms. However, the consequences of applying the standard indexical contextualist explanation–hidden-variable analysis– are too strong. (shrink)

Physical activity, body composition and sedentary behavior may affect the health of children. Therefore, this study examined the effect of an educational hybrid physical education program on physical fitness, body composition and sedentary and PA times in adolescents. A 9-month group-randomized controlled trial was conducted in 150 participants allocated into the control group and experimental group. Cardiorespiratory fitness, speed, strength, agility, flexibility and body mass index were assessed through previously validated field tests. Sedentary time, PA at school and afterschool were (...) evaluated with the Youth Activity Profile-Spain questionnaire. Significant differences were observed concerning to the CG in APA-weekend, speed-agility and agility. Regarding the intervention, cardiorespiratory fitness, speed-agility, strength, flexibility, agility, PA in school, APA-weekday, APA-weekend, APA-week, and sedentary time increased significantly in the EG. The use of a hybrid program based on teaching personal and social responsibility and gamification strategies produced enhancements in cardiorespiratory fitness, agility, speed, APA-weekdays and APA-weekends, reducing the sedentary time. Frente a las posiciones relativistas que consideran que no existe la posibilidad de trascender la perspectiva de una mirada necesariamente anclada en una u otra cultura y su equipaje conceptual, sostenemos que siendo innegablemente cierto que la ciencia es también un producto cultural, es sin embargo mucho más y se erige como un saber de tipo transcultural, es decir, que trasciende los elementos locales (...) de toda cultura y posee privilegios epistémicos que la posicionan por encima de cualquier otro tipo de conocimiento. In the United Kingdom, the debate about how best to meet the shortfall of organs for transplantation has persisted on and off for many years. It is often presumed that the answer is simply to alter the law to a system of presumed consent. Acting perhaps on that presumption in his annual report launched in July, the Chief Medical Officer, Sir Liam Donaldson, advocated a system of organ donation based on presumed consent, the so-called “opt-out” system.1 He is calling for (...) a change in the law in England and Wales whereby consent to organ donation is presumed, making a person’s organs automatically available for transplantation after death, unless they registered objections to this while alive. Subsequently, the British Medical Association lent its support to the introduction of such a system.2 The BMA contends that “the practice of presumed consent legislation has had a significant effect on the number of cadaveric donors per million population.”2It is often taken for granted that there must be a correlation between the enactment of legislation on presumed consent and an increase in organ donation and procurement. However, the correlation is not as straightforward as it might seem. It may be that other practical measures to encourage organ donation could be implemented without changing the Human Tissue Act 2004, an Act which has been in force for barely a year.An analysis by Abadie and Gay demonstrated that “presumed consent legislation has a positive and sizeable effect on organ donation rates”,3 but they themselves admitted that the correlation between rates of donation and presumed consent legislation is “not completely unequivocal”.3 It is true that among the most successful cases in procurement rates are countries with presumed consent legislation . Frail and elderly persons approaching end of life who suffer cardiac arrest are often subject to rigorous, undignified, and inappropriate resuscitation attempts despite poor outcomes. This scoping review aims to investigate how people feel about the appropriateness of CPR in this population. This review was guided by the PRISMA-ScR methodological framework. A search strategy was developed for four online databases (MEDLINE, EMCARE, PSYCHINFO, CINAHL). Two reviewers were utilised for title/abstract screening, full text review and data extraction. Full text, peer reviewed (...) studies were eligible for inclusion which discussed perspectives in the frail and/or elderly population with a focus on cardiopulmonary resuscitation (CPR). The database search yielded 3693 references (MEDLINE n = 1417, EMCARE n = 1505, PSYCHINFO n = 13, CINAHL n = 758). Following removal of duplicates (n = 953), title and abstract screening was performed on 2740 papers. A total of 2634 articles did not meet the inclusion criteria. Twenty-five studies were included in the scoping review and analysed for data extraction. Five themes emerged: (i) Preferences towards CPR, (ii) Preferences against CPR, (iii) Poor knowledge of CPR/Estimated survival rates, (iv) Do Not Resuscitate Orders, and (v) Decisional authority. This scoping review maps and describes the common perspectives shared by CPR stakeholders in the frail/elderly population. Findings revealed CPR decisions are often made based on incorrect knowledge, DNAR orders are frequently underused, CPR decisional authority remains vague and healthcare professionals have mixed views on the appropriateness of CPR in this population. The article aimed to determine the relationship between neuroscience and emotional states in university faculty members from Latin America during the post-pandemic stage of COVID-19. It highlights the importance of understanding emotions from a neuroscientific perspective to develop strategies that enhance emotional management and resilience in the educational context. The descriptive-correlational research included a sample of 318 faculty members from various Latin American countries. The results revealed severe levels of stress (88.4%) and anxiety (92.1%), as well as inadequate (40.9%) or (...) moderate (46.9%) levels of resilience among the faculty members. A strong positive correlation was found between neuroscience and emotional states (rho=0.860), as well as a good positive correlation between neuroscience and resilience (rho=0.739). The study concludes that the knowledge and application of neuroscience principles could contribute to lower levels of stress and anxiety and increase resilience in university faculty members, emphasizing the importance of integrating these disciplines into the understanding and management of emotions in the educational field. Finkelstein propone en La expresión y lo interno un análisis expresivista del autoconocimiento. Podría parecer cuando menos sorprendente y aún más admirable que con tan sólo dos capítulos (“Detectivismo y constitutivismo” y (...) “Expresión”) y un Epílogo (“Deliberación y transparencia”), Finkelstein haya conseguido presentar en esta obra un planteamiento calificado por muchos como una auténtica renovación de la discusión analítica en torno al tema del autoconocimiento, o sea, acerca del problema de qué clase de autoridad quepa atribuir a las expresiones sobre nuestros propios estados de ánimo y/o nuestros estados mentales sin más. Some authors sustain that historical research is an effect of a specific historiographical context (Jenkins, 1991; González de Oleaga, 2009). An approach to the historiographical debate between constructivism and recontructivism is presented in this paper. Two theses are here defended. The first one affirms that the above mentioned debate is deeply related to epistemological questions (study of mental representations, different conceptions about historical reasoning functions, historical reasoning, cognitive bias, and informal falacies). The second thesis affirms that each historiographical conception can (...) be understood as the effect of assuming a specific perspective about these epistemic questions. As an evidence of this, some connections between historiography and epistemology will be analysed through the analogy between the reconstructivism vs. constructivism debate, and the epistemological debate detectivism vs. constitutivism (Finkelstein, 2003). The paper explores Alonso de la Veracruz's theses on civil power, which sought to integrate the native inhabitants of the New World into the Spanish political community. These theses, which have usually been associated with F. de Vitoria and Spanish Thomism, have recently come to be considered part of a Novohispanic republicanism developed in the American periphery. The article seeks to show that the purpose of such theses was to apply a theory of natural rights that did not entail the political participation of the indigenous population, as well as to analyze Veracruz's position regarding cultural diversity and the war against the indigenous peoples. In discussions of the foundations of statistical mechanics, it is widely held that the Gibbsian and Boltzmannian approaches are incompatible but empirically equivalent; the Gibbsian approach may be calculationally preferable but only the Boltzmannian approach is conceptually satisfactory. I argue against both assumptions. Gibbsian statistical mechanics is applicable to a wide variety of problems and systems, such as the calculation of transport coefficients and the statistical mechanics and thermodynamics of mesoscopic systems, in which the Boltzmannian approach is inapplicable. And the (...) supposed conceptual problems with the Gibbsian approach are either misconceived, or apply only to certain versions of the Gibbsian approach, or apply with equal force to both approaches. I conclude that Boltzmannian statistical mechanics is best seen as a special case of, and not an alternatve to, Gibbsian statistical mechanics. (shrink)

I develop an account of how mathematized theories in physics represent physical systems, in response to the frequent claim that any such account must presuppose a non-mathematized, and usually linguistic, description of the system represented. The account I develop contains a circularity, in that representation is a mathematical relation between the models of a theory and the system as represented by some other model --- but I argue that this circularity is not vicious, in any case refers in linguistic accounts (...) of meaning and representation, and is simply a consequence of the fact that we have no unmediated, representation-independent access to the world. I argue that the metaphysical import of the Aharonov-Bohm effect has been overstated: correctly understood, it does not require either rejection of gauge invariance or any novel form of nonlocality. The conclusion that it does require one or the other follows from a failure to keep track, in the analysis, of the complex scalar field to which the magnetic vector potential is coupled. Once this is recognised, the way is clear to a local account of the ontology of electrodynamics ; (...) I sketch a possible such account. (shrink)

I discuss classical and quantum recurrence theorems in a unified manner, treating both as generalisations of the fact that a system with a finite state space only has so many places to go. Along the way I prove versions of the recurrence theorem applicable to dynamics on linear and metric spaces, and make some comments about applications of the classical recurrence theorem in the foundations of statistical mechanics.

I criticise the view that the relativity and equivalence principles are consequences of the small-scale structure of the metric in general relativity, by arguing that these principles also apply to systems with non-trivial self-gravitation and hence non-trivial spacetime curvature (such as black holes). I provide an alternative account, incorporating aspects of the criticised view, which allows both principles to apply to systems with self-gravity.

Philosophers like Shoemaker and Burge argue that only self-conscious creatures can exercise rational control over their mental lives. In particular they urge that reflective rationality requires possession of the I-concept, the first person concept. These philosophers maintain that rational creatures like ourselves can exercise reflective control over belief as well as action. I agree that we have this sort of control over our actions and that practical freedom presupposes self-consciousness. But I deny that anything like this is true of belief.

One of Chicago's great cultural achievements, the Institute of Design was among the most important schools of photography in twentieth-century America. It began as an outpost of experimental Bauhaus education and was home to an astonishing group of influential teachers and students, including Lázló Moholy-Nagy, Harry Callahan, and Aaron Siskind. To date, however, the ID's enormous contributions to the art and practice of photography have gone largely unexplored. Taken by Design is the first publication to examine thoroughly this remarkable institution (...) and its lasting impact. The crises of the twentieth century - wars, genocide, the proliferation of atomic weapons, the rise and fall of communism, the breakup of the family - have shaken our faith in modernity and in the fundamental conceit upon which it is grounded: that human beings are capable of providing their own moral and political order. Ideologies based on this conceit have at their heart the revolt against God that has so characterized modern history, and these ideologies have failed us. Walsh (...) contends that the solution is to recover the spiritual foundations of freedom and order. To make his case, he draws lessons from the intellectual pilgrimages of four contemporary thinkers who overcame the modern spirit of revolt against God: Dostoevsky, Solzhenitsyn, Camus, and Voegelin. He shows how each confronted the full consequences of secular messianism and found within his own experience the means of overcoming it. In the process of mounting a critique of modernity and articulating the direction in which the alternative lies, the four recovered what is in essence philosophic Christianity. They show us that beyond nihilism, beyond the revolt against God, there is the existential rediscovery of transcendent truth. Walsh believes liberal democracy is redeemable, but that its redemption hinges on our return to a proper understanding of human nature and to a spiritual foundation based on Christian principles. Memory, mother of the Muses by Zeus, has nurtured culture for nearly three millennia while her nemesis, forgetfulness, has been demonized as an agent of destruction. In the modern age, however, memory has grown increasingly burdensome, opening the way for a more positive assessment of forgetfulness. Nietzsche praises animals for an inability to remember that preserves their innocence and happiness, and Freud documents the discontents of a civilization that cannot forget. ;In tracing the recent development of these issues, the dissertation (...) focuses primarily on Walter Benjamin, Hans Blumenberg, and Thomas Pynchon. Benjamin and his anguished "angel of history" show the destructive psychological effects of trying to use human memory as a secular form of redemption. Blumenberg's philosophy of history makes it possible to trace memory's responsibility for redemption to the modern age's inflated notion of the subject. Blumenberg's work also emphasizes the importance of metaphor and narrative in mediating and creating historical understanding, and this aesthetic distance weakens memory's redemptive relation to the past. Pynchon's protagonists, too, find that their desire to make historical meaning fully present is overshadowed by their fear of such presence. By reconciling themselves to a profane aesthetic distance from the past, Blumenberg and Pynchon redeem themselves from the melancholy engendered by an overly ambitious memory. ;Thus the dissertation attempts to recover a more modest and less oppressive memory by understanding it as a way to distance rather than redeem past injustices. This reconception of the function of memory helps establish an equilibrium between the pensive memory of Benjamin's "angel of history" and the innocent oblivion of Nietzsche's animals. ;In addition to the three major figures named in the title, the dissertation devotes sections and excursuses to Friedrich Nietzsche, Sigmund Freud, Ernst Cassirer, Martin Heidegger, Virginia Woolf, Ernst Robert Curtius, Elie Wiesel, Primo Levi, Michel Foucault, and Thomas Kuhn.
